  1. Document everything from day 1. Day one is when you have decided you’re selling it to somebody close to you.  It is essential that you and your buyer both sit and talk about expectations. How to sell a house when the owner is deceased

One of the most important and valuable assets that we can have in this life is a house. We treasure it and hope to pass it on to our loved ones. Most property owners are advised by their executor or lawyer to create a trust for their real estate properties and eventually, a will, for the properties to be dealt with accordingly. This can be a very straightforward process as long as the proper steps are completed in advance.

I have met a lot of driven sellers over the years who wanted to talk about selling a property that was owned by their deceased family member(s). This could be a parent, uncle, or an aunt. Most of these sellers are clueless of their succeeding actions so I decided it would be wise to include this topic in our comprehensive guide on how to sell one’s house fast in Naperville if the owner is already deceased.

Here are the questions we are going to address:

  1. What happens to the house when one owner dies?
  2. What do you do when the only owner of the house dies?
  3. Can the executor sell the property?

What happens to the house when one owner dies?

Your attorney may ask, “How is the property titled?”. The simplest way to understand this is to look at the title ownership divided into the three basic concepts:

  1. Sole ownership
  2. Joint ownership
  3. Title by contract

You can be part of a joint ownership but you have to find out if it’s a joint ownership with rights of survivorship or without rights of survivorship.  

Joint ownership with rights of survivorship means two or more individuals own the real estate together and if one owner dies, the remaining owner continues to own the property.  On the other hand, Joint ownership without rights of survivorship means there also two or more individuals owning a specific percentage of the real estate property. Owner A can own 80% while owner B owns 20%. This is sometimes called owning the property as “tenants in common”.

It should be very clear to you who inherits the property after the owner dies so you can also know who has the right to sell it.

If you’re a homeowner reading this, do your estate attorney a big favor and go through each one of your assets, including your house. Make it clear who owns it and if possible, who can be the designated beneficiary. There are legal terms that will allow you to get the ownership out of the deceased owner’s hands and transfer it to the beneficiaries. It can go through court-supervision or in some cases, the beneficiaries of the real estate property will take over control since they survived the deceased owner.  

Whether or not the house that is in joined ownership will need to be probated will depend entirely upon how it is titled. Only then can you talk to the planning attorney about selling it if you decide to.

What happens to the house when one spouse dies? 

If you decide to sell your house in Naperville, it’s similar to how you would process the house sale if one spouse is still around, the only difference is you will need the title put solely in your name. If you complete the sale within a few years of your spouse’s passing, you’ll even be able to claim the tax exclusion you would have if you were still married.

  1. Find out if the asset will need to go through probate.
  2. Have the real estate attorney (or title company) remove your husband/wife’s name on the deed if the title is held as joint tenants with right of survivorship. If you’re the sole beneficiary, you’ll be able to sell it without going through probate.   3. Clear out the personal belongings. If the house has too many personal belongings, it will be harder for the buyer to visualize it as their home. Make the necessary repairs and other improvements.

If the deceased owner left a will, you may process a transfer of ownership according to what’s stated in the will. If there is no will, the death means “intestate”. The court will have to assign an executor to be in charge of the deceased’s estate including his real estate properties and other assets.

Can the executor sell the property?

This is the person named in the will or the court to oversee the entire estate of the deceased homeowner. They’re responsible for transferring the deed of the deceased’s property to the legal beneficiaries.

The named executor has no power to sell any real estate property which belongs to the estate until he or she has been appointed by the Surrogate’s Court. How will you know when someone is appointed?
